How Texas Classifies Drug Offenses & Sets Penalties

Texas drug offenses are governed by Chapter 481 of the Texas Health and Safety Code, known as the Texas Controlled Substances Act. The law assigns controlled substances to Penalty Groups 1, 1-A, 1-B, 2, 2-A, 3, and 4. The lower the Penalty Group number, the more severely the substance is treated and the harsher the penalties.

Penalty Group Classifications & Charge Severity

Penalty Group classification shapes every element of a drug charge. Penalty Group 1 includes opiates, cocaine, and methamphetamine. Possession of less than one gram is a state jail felony; possession of 400 grams or more is a first-degree felony carrying 10 to 99 years and up to $100,000 in fines. Penalty Group 1-B, added in 2021, covers fentanyl and its derivatives and carries enhanced penalties for manufacture and delivery compared to other Group 1 substances. Marijuana is handled separately within Chapter 481, charged strictly by weight, and remains illegal in Texas. Across all substances, penalties range from a Class B misdemeanor to a first-degree felony depending on the substance, the quantity, and whether the charge is possession or manufacture and delivery.

A Texas drug conviction reaches further than prison exposure. It triggers driver’s license suspension: one year for those under 21 and six months for those over 21. Reinstatement requires completion of a 15-hour Drug Education Program through the Texas Department of Licensing and Regulation.
